"summary": "The judgment of the Meghalaya High Court records the following account. On 14.05.2010, weekly market day at Langpih on the Assam-Meghalaya border, Assam Police personnel fired on civilians, killing a Langpih man, a Langpih man, a Langpih man and a Langpih man and injuring several others; Assam contended a mob had attacked the border outpost. The States of Assam and Meghalaya had each paid Rs. 3 lakh ex-gratia per deceased during the pendency of the writ petitions. The Division Bench held the four deaths in Assam Police firing admitted, fixed strict public-law liability on the State of Assam for the Article 21 violation, and ordered a further Rs. 2 lakh per widow (Rs. 8 lakh total), payable by the State of Assam and the DGP Assam within three months, without prejudice to other legal remedies. Matters not addressed in the cited judgment text are not recorded here.",

"court_quote": "From the above discussions, we are of the considered view that the writ petitions of this nature for a direction to pay monetary compensation for the deprivation of the fundamental rights of the citizen and for the death of citizen as a result of Police firing is maintainable inasmuch as a remedy for payment of monetary compensation is available in public law based on strict liability for contravention of the fundamental rights to which the principle of sovereign immunity does not apply, even though it may be available as a defence in private law in an action based on tort. For deciding the amount of compensation to be paid under the public law realm, we have given our anxious consideration to the age of the said four persons and their earnings which are mentioned in the writ petitions and we are of the considered view that each of the writ petitioners should be paid further amount of Rs.2 lakhs as compensation over and above, the amount of 6 lakhs which are already been received by each of the petioners as ex-gratia.",

"summary": "The judgment of the Meghalaya High Court records the following account. Taxi driver [name withheld] was intercepted near Nongthymmai on 09.09.2011, taken to Madanriting Traffic Branch over an alleged traffic offence, and assaulted by UBC [name withheld] when he could produce only Rs. 170 of the demanded fine, suffering a bleeding lacerated injury to his left eye. A departmental proceeding had already found the constable guilty beyond any shred of doubt and imposed censure. The High Court held the assault an established infringement of the indefeasible right under Article 21 and awarded Rs. 40,000 as exemplary damages payable jointly or severally by the State, DGP and SP within 40 days. It directed recovery of Rs. 10,000 from the respondent constable salary after payment to the petitioner. Matters not addressed in the cited judgment text are not recorded here.",

"summary": "The judgment of the Meghalaya High Court records the following account. [name withheld] of the Meghalaya police was summarily dismissed on 15 January 2016 after a confidential report found he had passed information about police operations and movements to the banned Garo National Liberation Army (GNLA) outfit, at a time when the outfit's violence had killed several police personnel; inquiry was dispensed with under Article 311(2)(b). His departmental appeal was rejected in October 2019 and a Single Judge upheld the dismissal in December 2021. A Division Bench of Chief Justice Sanjib Banerjee and Justice W. Diengdoh dismissed his writ appeal, holding that when a policeman betrays his force to an outlawed outfit the police were combating, inquiry could justifiably be held not reasonably practicable, and that reasons obvious and apparent satisfy the spirit of Article 311(2)(b).",

The Court rejected the defence that the survivors' alleged prostitution discredited them and that their age was unproved, holding there could be no reasonable doubt as to culpability.
