Sub-Inspector, officer-in-charge of Shalimar GRPS from December 1948, faced seven charges of misappropriation in malkhana goods sales during 1948-1950 following anonymous complaints, CID investigation and a DSP enquiry, and was dismissed on 21 August 1952. The court held that departmental findings honestly and impartially reached on circumstantial evidence were unexceptionable. It found no violation of Articles 311 or 320(3)(c), held the section 42 Police Act limitation inapplicable to departmental enquiries, and held the enquiry officer's dual role did not vitiate the findings. The application failed, the Rule was discharged and all interim orders vacated. Matters not addressed in the cited judgment text are not recorded here.

> All that has to be seen is as to whether he had honestly and impartially come to a conclusion which a reasonable man could arrive at. Judged by this test I find no error on the face of his findings.
