The Supreme Court dismissed the appeals of two Delhi police constables, led by \[name withheld\], upholding their conviction by the Special Judge, Delhi under Section 120B and Section 224/109 IPC and Section 5(2) of the Prevention of Corruption Act, 1947. The Court found that between 6 and 16 November 1955 they conspired to bring about the escape of undertrial M.P. Khare from lawful custody, agreeing to accept illegal gratification and abetting the escape, with gratification accepted from Nand Parkash Kapur. It rejected the challenge to the approver's pardon granted by the District Magistrate under Section 337 CrPC 1898, holding a Special Judge's court is a Court of Session for that purpose. The sentence of two years' rigorous imprisonment under Section 5(2) and nine months under each IPC count stands. Matters not addressed in the cited judgment text are not recorded here.

> The findings of the High Court establish the offence of the appellants under s. 5(2) of the Prevention of Corruption Act, 1947, and we can find no sufficient reason to think that the appellants were wrongly convicted thereunder. The appeals are accordingly dismissed.
