The judgment of the Allahabad High Court records the following account. The appellant, a constable at Police Station Shikarpur, Bulandshahr, was charged with other constables under section 7 of the Police Act for arresting a Shikarpur man on 10 April 1959, fracturing his legs, and concealing it with a false general-diary report. The Superintendent of Police dismissed him on 29 June 1959 after a departmental enquiry; his departmental appeal and revision failed, as did his civil suit in first appeal. The Court held the enquiry by the authorised Deputy Superintendent of Police was competent under the Police Regulations and the dismissal procedure valid. The Court dismissed the second appeal with costs, leaving the dismissal standing. No criminal prosecution outcome is recorded in this judgment.
