The Supreme Court dismissed Head Constable's appeal, upholding his conviction by the Gujarat High Court under Section 161 IPC and Section 5(2) read with Section 5(1)(d) of the Prevention of Corruption Act, 1947, after the trial court had acquitted both accused. The Court accepted that a Zinzuwada man, produced at the police station on 11 July 1968 in an abduction-matter investigation, was threatened with handcuffing, lock-up and parading unless he paid, and that an anthracene-powder trap caught the appellant accepting Rs. 500 the next evening. It upheld the statutory presumption under Section 4(1) of the 1947 Act and rejected the objection under Section 537 CrPC 1898 to conviction under Section 161 simpliciter. The sentence of two years' rigorous imprisonment stands, with no separate sentence under Section 161, and the co-accused-Inspector's acquittal was left undisturbed. Matters not addressed in the cited judgment text are not recorded here.

> For the foregoing reasons, the appeal fails and is dismissed.
