A Full Bench of the Madhya Pradesh High Court (Gwalior) on 15 September 1976 dismissed the second appeal of Sub-Inspector, upholding his dismissal from the police force. The court recorded that the SI, tried under Sections 330/331 IPC and convicted only under Section 323 by the trial court on 26 February 1954, was convicted by the High Court under Section 330 IPC on 6 November 1957 and sentenced to three months' rigorous imprisonment plus a Rs. 200 fine. The Inspector-General of Police dismissed him with effect from the conviction date under Rule 246 of the Police Regulations. The Full Bench held that a rigorous-imprisonment sentence imposed by the High Court falls squarely under Rule 246 and that a conviction-consequential dismissal under the second proviso to Article 311(2) needs no departmental inquiry.
