The Karnataka High Court (Rama Jois J., 8 November 1982) rejected the writ of Sub-Inspector and sustained his dismissal from service. The court recorded that while posted as ASI at Bajpe Airport he assaulted on-duty traffic constable at Mangalore on 1 October 1980, for which the JMFC convicted him under Section 353 IPC and sentenced him to 3 months RI. The court held the dismissal validly founded on the conduct that led to the conviction, and that suspension of the sentence pending appeal did not wipe out the conviction.
