The Supreme Court set aside the Bombay High Court order and restored the removal from service of Police Inspector, who in uniform visited the survivor's hutment near Bhiwandi Town PS on 13 November 1965, demanded sexual intercourse and tried to take her by force. The Court rejected the High Court's approach of disbelieving the woman as unchaste, holding her evidence was corroborated by her husband, PSI and the police party. The departmental finding of perverse conduct was upheld. Salary paid for duty rendered during the High Court-ordered reinstatement was not made recoverable.
