The Delhi High Court (Y.K. Sabharwal, J.) awarded Rs 20,000 (payable within one month) plus Rs 1,100 costs for the illegal detention of the wrong man for one month and nine days. Assistant Mistri a Kashmere Gate man was arrested on 15 August 1991 as the namesake proclaimed offender wanted since 1983 — though his father's name (not Ram Singh) and address differed from the charge-sheet — and, despite protesting from arrest and again on 16.8.1991, was refused bail by the Magistrate and once by the Sessions Court before another Sessions Judge granted bail (released 23.9.1991); a Magisterial enquiry (26.9.1992, with the unnamed 1983 Investigating Officer confirming he was not the man) proved the mistaken identity.
