The Patna High Court allowed a criminal writ petition filed by Dulari Devi for the custodial death of her 27-year-old husband, a Jagdishpur man, who died in Central Jail Bhagalpur on July 28, 1994, following severe beatings in police custody. On July 24, 1994, a police party led by DSP tied up and assaulted a Jagdishpur man and neighbor a Jagdishpur man with lathis, assaulted them further at Jagdishpur police station, and falsely implicated them under the Arms Act. The Court held that the deceased died due to excessive torture inflicted by the four police respondents, directed the State to deposit Rs. 1,50,000 compensation and Rs. 5,00,000 costs with liberty to recover the sum from the guilty officers, and instructed the State to consider initiating criminal prosecution against them. Matters not addressed in the cited judgment text are not recorded here.

> On the contrary, the material available on record including the admitted facts amply goes to show that the husband of the petitioner died because of excessive torture meted out to him by the respondent Nos. 7 to 10. Now the question arises as to the quantum of compensation.
