The Gauhati High Court held that Ningthoujam Angou Singh, a PHED pump operator, died in the custody of Chandel police on 28 January 1989, hours after a six-man armed party led by ASI took him from his home without disclosing any case. The Court found he was brought to Chandel hospital in a dying condition with severe injuries and that police fabricated an arrest in FIR 5(1)89 under Section 302 IPC. It allowed the CLAHRO petition and directed the State to pay Rs 2,00,000 to the widow and minor children within three months. The Court left it open to the State to recover the amount from the persons found responsible for the custodial death. Matters not addressed in the cited judgment text are not recorded here.

> On careful perusal of the documents placed before us and after hearing counsel of both sides and in the facts and circumstances narrated above, we are of the view that death of N. Angou Singh in police custody has been established. In such a situation, the only remedy we can think of is to award compensation so that the members of the family of the deceased may not be driven to destitution.
