The judgment of the Gujarat High Court records the following account. Unarmed Police Constable of the Ahmedabad Traffic Branch was dismissed after a departmental inquiry proved the second charge of conduct unbecoming a government servant in keeping a mistress, following an earlier penalty of withheld increments for abusive language under the influence of liquor. The City Civil Court decreed his suit, declared the dismissal illegal, and ordered reinstatement with full benefits. On the State's appeal, the Gujarat High Court held police personnel guilty of such character and conduct must be taken more seriously, set aside the decree, dismissed the suit, and thereby restored the dismissal.
