The judgment of the Gujarat High Court records the following account. On 24 July 1985 at about 6 p.m., PSI shot dead an Ahmedabad man, a 38-year-old tax practitioner, near Nava Darwaja, Ahmedabad. The family sued the State and the PSI for Rs.5 lakh, alleging unauthorised, negligent firing; the City Civil Court decreed Rs.4,35,000 with 10% interest in 1999, holding the deceased a victim of the PSI's negligent and tortious act. The State appealed, claiming the death was caused by private firing during communal riots. The High Court held the firing was without permission and authority, that no mob or curfew was proved, and that the deceased was shot dead without reason by the negligent, reckless and unauthorised act; it dismissed the appeal with costs, confirmed the decree, and directed deposit of the decretal dues within six months.
