The Delhi High Court (R.S. Sodhi, J.) on 17 November 2000 allowed the writ petition of Iqubal Begam and directed the State to pay Rs 3,50,000 as compensation for the custodial death of her 68-year-old husband \[name withheld\] at Police Station Seelampur on 27/28 August 1994. The court held on the Section 176 CrPC magisterial-inquiry record, DD entries, MLC and post-mortem evidence of seven ante-mortem blunt-force abrasions that the deceased remained in continuous police custody from 7.50 p.m. until declared dead at 00.40 hrs, and that inflicted brutality had precipitated his fatal cardiac condition. It held the State and its functionaries had caused the death in custody in a manner the law has repeatedly deprecated, and found the Rs 50,000 earlier paid under NHRC orders grossly inadequate but deductible. The State's appeal was dismissed by a Division Bench on 22 May 2004, leaving the award intact.

> Therefore, from material on record it is clear that the death of the husband of the petitioner, a Delhi man, can be termed as 'custodial death' and even if the deceased was suffering from heart problem, the brutality inflicted upon him only precipitated the condition which proved fatal.
