The High Court held that 25-year-old \[name withheld\], arrested in a TADA case by a Khairabari PS party in the early hours of 4 December 1994, was assaulted and tortured to death by police while in custody at Mangaldoi Police Station the same night. Relying on the Darrang District Judge enquiry, including eyewitness co-detenues, the Court rejected the police story that the handcuffed detenu fell while fleeing. The Court awarded Rs 2,00,000 compensation to his mother and directed the CBI to register an FIR and investigate; the Division Bench dismissed the State appeal in 2006 with Rs 10,000 costs, noting the State had already paid the compensation.
