The Madhya Pradesh High Court (Gwalior Bench, Justice S.S. Jha) awarded Rs 25,000 jointly and severally against the State and SDM \[name withheld\] for a Sheopur Kalan man's illegal detention from 28 to 30 January 1997. Arrested on 27 January 1997 in a land-dispute case and bailed by the ACJM on 28 January, the petitioner was instead shown freshly arrested under s.151 CrPC, his bail rejected by the SDM on a substituted order-sheet, and kept in jail till 30 January. The Court held the Town Inspector could not invoke s.151 once the accused was already arrested for substantive offences, found the SDM's malafides and record manipulation apparent, ordered an enquiry against the SDM with recovery, costs on the SDM, and preventive directions via the Chief Secretary. Later proceedings: on 10 November 2010, the Madhya Pradesh High Court, Division Bench (Gwalior) set aside the conviction/order concerning \[name withheld\], \[name withheld\]; the findings against the remaining officers stand as recorded in this judgment.
