The judgment of the Calcutta High Court records the following account. While Chief Law Instructor at the Police Training College, Barrackpore, DySP \[name withheld\] demanded Rs. 6,000 from Cadet SI on 9 October 1980 on the false plea of placating the DIG (Training) and accepted it on 13 October 1980, besides attempting a further Rs. 4,000. A Vigilance Commission enquiry found him guilty of both charges, and the Governor permanently withheld 50% of his pension with effect from 1 March 1982. The West Bengal Administrative Tribunal set aside the cut, but the Calcutta High Court held Rule 10 of the WBS (DCRB) Rules, 1971 permits post-retirement pension action and set aside the Tribunal's order. The Governor's pension-withholding order was affirmed on 21 September 2001. Matters not addressed in the cited judgment text are not recorded here.

> For the reasons aforesaid the impugned order of Tribunal is set aside. The writ application filed before us stands allowed. The order of the Governor withholding pension in the manner indicated above is hereby affirmed.
