The Allahabad High Court (single Judge, 26-8-2002) dismissed the appeal of Police Constable of Police Station Fatehpur, Barabanki, and upheld his six-year rigorous imprisonment conviction under section 376 IPC imposed by the Sessions Judge on 11-3-1987. The court found that on 9-5-1985, inside police station premises, the appellant took the infant daughter of a Sub-Inspector family into his quarter and raped her, crediting the eyewitness account of the mother and the independent witness \[name withheld\]. The court held the medical evidence proved rape of a girl aged less than one year beyond doubt and found no illegality in the trial court order. It cancelled bail, discharged sureties, and directed the Chief Judicial Magistrate, Barabanki, to arrest the appellant to serve the sentence. Matters not addressed in the cited judgment text are not recorded here.

> The statement of Medical Officer proves beyond doubt that the girl who was less than one year, was subjected to rape by the appellant. There is absolutely no reason to discard the prosecution case and the learned Court below was fully justified in believing the prosecution case, convicting the appellant and I find no illegality or impropriety in the said order passed by the learned Court below.
