The Gujarat High Court (M.D. Shah, J.) on 23 July 2008 partly allowed Criminal Appeal No. 1055 of 1993, upholding the corruption conviction of traffic policeman by the Special Judge, Ahmedabad city (26 July 1993). The court held proved beyond doubt that, while attached to Traffic Court (Court No. 13) Gheekanta, he demanded money at Rs. 15 per complaint from auto-rickshaw driverW.-1 to dispose of 15-16 pending traffic complaints and accepted Rs. 150 in an ACB trap on 27 December 1989. It rejected the defence that he took the money only to secure the driver's court presence, holding police officials were not authorised to collect fine amounts directly. Given ~19 years had passed, it reduced the three-year sentences to one year rigorous imprisonment on all counts, concurrent. Matters not addressed in the cited judgment text are not recorded here.

> In view of the above discussion and taking into consideration the facts and circumstances of the case and the evidence available on record, I have no hesitation in holding that the amount of Rs.150/- received by the appellant from P.W.-1 on 27.12.1989 was an illegal gratification and that the ingredients of bribe i.e. demand, offer and acceptance has been successfully proved by the prosecution beyond reasonable doubt.
