The Madras High Court Division Bench (Justices P.K. Misra and R. Subbiah, judgment by R. Subbiah, J.) dismissed both the State's and the heirs' appeals against the 8 August 2003 single-judge award of Rs 3 lakh for an Adirampattinam man's illegal detention. Taken to Athirampatnam police station on 27 November 1994 over a robbery complaint, an Adirampattinam man was kept in unrecorded custody till production before the Magistrate on 3 December 1994 with severe injuries, a detention the State admitted in appeal. Upholding the award with interest lying in deposit (releasable via the Registrar General), the Court held D.K. Basu guidelines were given a go-by and Article 21 violated. Matters not addressed in the cited judgment text are not recorded here.

> It is not disputed by the respondents in the appeal that the deceased appellant was in illegal custody from 27.11.1994 to 03.12.1994 i.e. more than a week and he was harassed by the 6th respondent.
