The Punjab and Haryana High Court dismissed the appeal of ASI, Incharge of Police Post Palam Vihar, Gurgaon, who had demanded Rs.10,000 from civil contractor \[name withheld\] to delete his name from a case and release his seized Maruti van, beating him when he resisted. The Special Judge, Gurgaon had convicted him under s.13(1)(d)(ii) of the Prevention of Corruption Act, 1988 and sentenced him to two years rigorous imprisonment with a Rs.1,000 fine. The High Court held demand and acceptance of gratification proved, rejected challenges to delay, witnesses and sanction, and upheld the conviction and sentence while converting the conviction to s.13(2).
