The Punjab and Haryana High Court dismissed the appeals of a Gurgaon CIA Inspector and ASI, upholding their 7-year sentences for torturing a Gurgaon man to death in custody after he was picked up on 9 February 1993 and transferred from Delhi to CIA Staff Gurgaon. The Court relied on the jail register injury entry, the post-mortem head injury and the destruction of two MLRs, applying the custodial-death burden shift to the custodians. It held the conviction well-founded and well-reasoned. The trial acquittals of four Delhi Police officials were left undisturbed and the complainant revision was dismissed. Matters not addressed in the cited judgment text are not recorded here.

> It is also well settled by now that when a person is in custody of the police and confined there, he is proved to have received injuries or died then no amount of further evidence was required to be produced by the prosecution in order to establish as to how and in what manner he died or received injuries, then the onus shifts upon the officers who remained his custodians.
