The judgment of the Karnataka High Court records the following account. Police Constable (PC No. 1709) of A Company, City Armed Reserve, Bengaluru, abused RSI a Bengaluru man and ASI in foul language on the parade ground on 2 March 2001, assaulting the RSI and attempting to assault a Bengaluru man with a lathi before others intervened. A departmental enquiry found the misconduct proved and he was dismissed, with appeal and revision failing; the Karnataka Administrative Tribunal sustained the misconduct finding but substituted compulsory retirement noting 15+ years of service. He sought reinstatement with back wages under Articles 226/227. The High Court held four fact-finding authorities concurrently found the misconduct proved and the Tribunal's lenient penalty met the ends of justice, dismissing the writ petition.
