The Supreme Court dismissed the appeal of police personnel convicted for the brutal May-June 1992 atrocities at Annamalai Nagar Police Station, where suspect a man was tortured to death with lathis and his wife the complainant was subjected to barbaric custodial gang-rape. Affirming the concurrent convictions by the trial court and the Madras High Court, the bench led by Justice Markandey Katju held the testimonies of 37 prosecution witnesses, particularly the harrowing account of victim the complainant, to be credible beyond reasonable doubt. The Court strongly criticized the failure of lower courts and investigators to frame charges under Section 302 IPC for murder, observing that custodial killings by police are rarest of rare crimes deserving the death penalty, but upheld the 10-year rigorous imprisonment sentences under Section 376(2)(a) IPC as well as convictions for wrongful confinement and voluntarily causing hurt. Matters not addressed in the cited judgment text are not recorded here.

> Both the trial Court and the High Court have found the appellants guilty and we see no reason to disagree with their verdict. To prove the charges the prosecution examined as many as 37 witnesses, and they have proved the guilt of the accused beyond reasonable doubt.
