The judgment of the Bombay High Court records the following account. Head Constable of Sahar police station took a ~14-year-old beggar girl in an autorickshaw on 17.10.2005 and sexually assaulted her near a temple wall until a passer-by intervened. The trial court convicted him under ss.363, 366, 376(2)(a) and 323 IPC with 15 years RI for rape. The court held the victim a minor whose consent was irrelevant and kept the ss.363/366/323 convictions, but held penetration unproved, converting the rape conviction to attempt under s.376(2)(a) r/w s.511 IPC with sentence reduced to imprisonment already undergone plus Rs.10,000 fine payable to the victim. Matters not addressed in the cited judgment text are not recorded here.

> In view of the facts and circumstances noted above, while in respect of conviction and sentences for the charges under sections 363, 366, 323 Indian Penal Code, no interference is called for, he is entitled to be acquitted for the charges under section 376 (2) (a) but is liable to be convicted for the offence for attempt to commit rape punishable under section 376 (2)(a) read with section 511 of the Indian Penal Code, because the accused committed that offence within the local limits of the police station where he was appointed as a head constable.
