The Delhi High Court dismissed the writ petition of Delhi Police Head Constable Mahender Singh and upheld his removal from service for corrupt practice, holding the enquiry had proved that on 19 February 2008 he stopped a vigilance-decoy vehicle at Aaya Nagar picket for a seat-belt violation, settled the Rs 1,200 challan for a Rs 200 bribe, and had Constable collect the marked notes, which were recovered from \[name withheld\]'s pocket by the vigilance team on camera. The Court rejected the objection under Rule 15(2) of the Delhi Police (Punishment & Appeal) Rules, holding that proceeding departmentally rather than by criminal trial under Sections 7/13(1)(d) of the PC Act was comparatively favourable to him and caused no prejudice. It held the removal penalty was not disproportionate and agreed that a police official indulging in such corrupt activities needs to be weeded out of the force.
