Head Constable, with 23 years of service in the Madhya Pradesh Police, was charge-sheeted on 8 June 2001 on two charges arising from an incident dated 20 July 2001, and a regular departmental enquiry found both charges established on the evidence of eyewitnesses, leading to dismissal from service affirmed on appeal. He challenged the dismissal on grounds including reliance on a preliminary enquiry, hearsay, the incident occurring off duty hours and outside his posting area, and disproportionality. The Madhya Pradesh High Court held it was not a case of no evidence, that off-duty conduct reflecting on establishment discipline amounts to misconduct, and that the charges were very grave with punishment commensurate to the misconduct.
