The judgment of the Kerala High Court records the following account. Head Constable, Station Writer at Fort Police Station, was trapped by the Vigilance and Anti-Corruption Bureau on 10 December 1998 accepting two phenolphthalein-marked Rs 100 notes to release a surety's seized bicycle, watch, pen and wallet; though the complainant turned hostile on the Rs 1,500 demand, trap witnesses, chemical tests and recovery from his shirt pocket proved voluntary acceptance. The Special Court had convicted him under Sections 7 and 13(1)(d) read with Section 13(2) of the PC Act with three-year sentences. The Kerala High Court set aside the Section 7 conviction for want of proof of demand but confirmed the Section 13 criminal-misconduct conviction, reducing the sentence to one year rigorous imprisonment with Rs 10,000 fine. Later proceedings: on 29 January 2015, the Supreme Court of India acquitted \[name withheld\] of all charges on appeal; the convictions recorded in this judgment therefore do not stand. Matters not addressed in the cited judgment text are not recorded here.

> In this case, there is sufficient evidence to find that PW2 had paid two `100/- decoy notes to the appellant and he voluntarily accepted money as bribe. Therefore, I am of the definite view that the conviction of the appellant under Section 13(1)(d) of the Act is to be upheld.
