The judgment of the Bombay High Court records the following account. Sagar Ubhe alleged he was picked up on 25.01.2012 and kept at Crime Branch Unit II, Pune without intimation or magistrate production till 30.01.2012, beaten to extract a confession; police claimed arrest only on 29.01.2012. A JMFC enquiry found illegal detention and tampering of the arrest register date. The court accepted the enquiry report, held the 25-30 January 2012 detention and the subsequent Yerawada re-arrest entirely illegal, and directed the State to pay Rs.5,00,000 compensation within 8 weeks.
