The judgment of the Delhi High Court records the following account. Delhi Police Constable, on patrolling duty with a.38 service revolver, shot a Mayur Vihar man in the chest during a road quarrel near Mayur Vihar around 12:30 AM on 17 September 2004, leaving him in ICU. The Trial Court convicted him under Section 307 IPC with ten years RI and a Rs 25,000 fine in September 2011. The Delhi High Court held the firing had no reasonable nexus with official duty so no sanction bar arose, and that the injured witness's testimony stood corroborated by medical and eyewitness evidence. It sustained the conviction, reduced the sentence to seven years RI, directed Rs 20,000 of any realised fine as compensation to the victim, and dismissed the appeal with that modification.
