The Delhi High Court upheld the CBI-court conviction of two Patel Nagar Sub-Inspectors for beating a Patel Nagar man to death in custody over an unmet illegal demand of Rs 10,000. On the intervening night of 22-23 August 1986 the officers picked up a Patel Nagar man from home, beat him and his intervening uncle a Patel Nagar man continuously en route and at the station, and a Patel Nagar man died with ten ante-mortem blunt injuries; the police then took him to hospitals to cover up the death. Relying on the nephew's complaint-FIR corroborated by medical evidence, the Court maintained 10 years RI under Section 304-I read with Section 34 plus one year under Section 342/34 and a Rs 25,000 fine from each convict payable as compensation to the widow (Rs 50,000 total), while acquitting a constable and the CFSL Scientific Officer co-accused and setting aside the Section 218/109 convictions. The appellants denied the charges and pleaded false implication. Matters not addressed in the cited judgment text are not recorded here.
