The Jharkhand High Court (Pramath Patnaik J.) dismissed a CISF constable's writ against his dismissal dated 29 July 2002. The court found he was drunk on firing-point duty at HEC Ranchi on 15 October 2001 and disobeyed a lawful order to deposit his rifle, against a record of one major and 18 minor prior punishments. It held that punishment choice lies exclusively with the competent authority and no interference on quantum was warranted. The dismissal, already affirmed in appeal and revision, therefore stands.

> Furthermore, the petitioner has been examined by Dr. S.K. Kisku and the medical report of Dr. Kisku finds corroboration in the inquiry conducted by the inquiry officer. Therefore, the conclusion is irresistible that the petitioner consumed alcohol.
