The Jharkhand High Court (Pramath Patnaik J.) dismissed a Dhanbad constable writ against his dismissal dated 6 March 2010. The court found proved gross negligence on prisoner-ward guard duty at PMCH, where an undertrial suffered burn injuries on 22 September 2008 and an inspection later found no uniformed guard at the ward. It held three concurrent evidence-based findings cannot be reappraised under Article 226 given the serious misconduct. The dismissal, affirmed in appeal and revision, therefore stands.

> As per the statement of the accused, there was candles and matches in the prisoner ward, the fire incident took place due to absence of the petitioner and others on the spot the fire engulfed.
