The Supreme Court held Jammu and Kashmir Police personnel misused power and violated the fundamental rights of three petitioners during the 7 August 2007 dispersal near Katra of about 2,000 Jammu migrant protesters marching to Delhi. The Court found initial force justified as the agitation turned violent, but held police continued the lathi charge beyond limits and kept beating all three petitioners even after overpowering and virtually apprehending them. Finding the petitioners partly to blame, the Court declined criminal action and a special investigation, granting only compensation of Rs 2 lakh to petitioner1 and Rs 1 lakh each to petitioner2 and 3. Matters not addressed in the cited judgment text are not recorded here.

> On the other hand, even the police personnel continued the use of force beyond limits after they had controlled the mob. In the process, they continued their lathi charge. They continued to beat up all the three petitioners even after overpowering them.
