The Jharkhand High Court Division Bench allowed the State appeal and restored the dismissal of constable, setting aside the Single Judge order of 13 November 2013 that had reinstated him with full back wages. The court found he had secured appointment under the 50 percent trained Home Guard quota by annexing only an identity card though his 45-day training was incomplete on the closing date, a misrepresentation exposed on verification. The court held the enquiry, with charge sheet, hearing and second show cause, adequate and the dismissal by the SP, affirmed by the DIG Kolhan Range, proportionate for grave indiscipline in a disciplined force.
