The Jharkhand High Court Division Bench allowed the Union of India appeal and restored the dismissal of CISF Constable, setting aside the Single Bench order of 8 March 2013. The court held that his admitted abandonment of the Shatabdi Bhawan strong-room post during the 1999 Lok Sabha elections, leaving a 7.62mm rifle and 50 rounds unguarded, amounted to dereliction, negligence, indiscipline and wilful disobedience. It disbelieved the illness defence and held dismissal was not disproportionate for a member of a disciplined force. The dismissal of 25 September 2000, already affirmed in appeal and revision, therefore stands.

> As a cumulative effect of the aforesaid facts, reasons and judicial pronouncements, the judgment and order delivered by the learned Single Judge in W.P. (S) No. 864 of 2002 dated 8th March, 2013 is, hereby, quashed and set aside and we, hereby, uphold the order passed by the disciplinary authority dated 25th September, 2000 (Annexure-3) as well as the order passed by the appellate authority dated 08th January, 2001 (Annexure-4) and the order passed by the revisional authority dated 25th July, 2001(Annexure- 5).
