The judgment of the Patna High Court records the following account. \[name withheld\] was appointed as a CRPF constable in 147 Battalion at Kashipur, Silchar on his declaration of Scheduled Tribe status. Verification by the Sub-Divisional Magistrate, Jagdishpur found the caste certificate forged and fake and the appellant outside the ST category, and the Commandant dismissed him on 25.10.2007. A Single Bench dismissed his writ (CWJC 11660/2008) on 07.05.2014 after traversing the enquiry. On appeal, the Division Bench held services obtained by foul method cannot be protected by any court and the direct beneficiary cannot be rewarded for his own wrong. The appeal was dismissed and the dismissal from service stands.
