\[name withheld\], an Assistant Sub-Inspector posted at Daudnagar Police Station, Aurangabad, left for court work to Aurangabad on 24.01.1994 and absconded for about 630 days, reappearing only on 16.10.1995 at Police Centre Aurangabad. The DIG Magadh Range dismissed him on 14.02.2002 after a departmental proceeding in which he did not participate despite personal service of the charge memo; his memorial to the DGP was rejected on 26.08.2008. He challenged the dismissal under Article 226 alleging natural-justice violations. The Court examined the entire departmental record, found two witnesses had proved the charge with full opportunity given, and held 630-day absconsion rightly draws dismissal lest Force discipline suffer. The writ petition was dismissed and the dismissal from service stands. Matters not addressed in the cited judgment text are not recorded here.

> Considering the judgment of the Hon'ble Apex Court in Ashok Kumar Singh Case (Supra), the Court is of the opinion that since the petitioner remained absconding for about 630 days, the disciplinary authority has rightly passed order of dismissal of the petitioner. In such case there was no reason to take any lenient view, otherwise it would have hampered the discipline of the Armed Forces.
