The Delhi High Court (Rekha Palli and Vipin Sanghi, JJ.) on 21 September 2017 dismissed the writ petition of Delhi Police Constable and upheld his dismissal from service. The court recorded that on 15 April 1996 a four-man Special Staff team including the petitioner illegally picked up shopkeeper \[name withheld\] and his two servants on a false accusation of manufacturing spurious cold drinks, demanded Rs. 50,000, and released them on 16 April 1996 after receiving Rs. 30,000 as bribe. It held this was not a case of no evidence, finding the uncontroverted statement of complainant \[name withheld\] alone sufficient to hold the charges proved, and saw no infirmity in the Tribunal's order. The petitioner had been dismissed on 7 November 1997 after a joint departmental enquiry rejected his alibi defence. Matters not addressed in the cited judgment text are not recorded here.

> Having examined the record, including the findings of the Enquiry Officer and the order passed by Disciplinary Authority, we do not find that this is a case of 'no evidence'. In fact, we find that there was sufficient evidence before the Enquiry Officer to hold the Petitioner guilty of the charge levelled against him.
