The judgment of the Delhi High Court records the following account. Delhi Police Constable (Mounted) \[name withheld\] faced a departmental inquiry from April 2011 for outraging the modesty of a woman constable and absence from duty, with FIR No. 42/2011 under Sections 354/34 IPC registered at PS Civil Lines against him and two other police officers. Found guilty departmentally, he was dismissed from service on 28.08.2012, lost his departmental appeal in April 2013, and lost before the CAT in September 2018, though acquitted in the criminal trial in May 2018. The Delhi High Court held the criminal acquittal was not clean and on merits so as to bar departmental proceedings under Rule 12, found he played the main role in the incident, and dismissed his writ petition as meritless. Matters not addressed in the cited judgment text are not recorded here.

> We find that the petitioner has been held to be guilty of the charges of outraging the modesty of a woman, and remaining absent from duty by a duly constituted inquiry, where he was given due opportunity to cross-examine all the witnesses, including the complainant, who had, in no uncertain terms, stated the manner in which the petitioner had caught hold of her inappropriately. There is absolutely no reason to interfere with the well considered findings of the IO in the departmental inquiry or with the findings of the Disciplinary Authority and the Appellate Authority.
