The Division Bench dismissed police constable 's writ appeal against the Single Judge's order dated 18 April 2016, upholding his dismissal from service ordered on 11 March 2003. The court held all three departmental charges proved: 43 days of unauthorised absence, misbehaviour with a victim woman, and incorrigible conduct despite earlier punishments. It rejected his technical pleas about the enquiry procedure, finding no prejudice, and held that his acquittal in the related criminal case did not undo the departmental finding. The court found no illegality in the Single Judge's order and dismissed the appeal as sans merit.

> For the foregoing discussion, we do not find any illegality or infirmity in the impugned order passed by learned Single Judge warranting interference by this Court in exercise of its appellate jurisdiction. The writ appeal sans merit and is accordingly dismissed.
