The judgment of the Patna High Court records the following account. On 28 December 2000, a Patna man was shot dead near Kumhar police post while on his way to Sandalpur Hostel, during an exchange of fire between police and criminals; official reports admitted an innocent passerby died in the shootout. His father moved the DM, the NHRC and an earlier writ without relief before filing this petition. The court held the State strictly liable in public law for the Article 21 violation, ruling negligence need not be proved and operational compulsions cannot justify loss of innocent life, and awarded Rs.10,00,000 compensation with 24% interest on delayed payment while declining compassionate appointment.
