The judgment of the Jharkhand High Court records the following account. JAP-1 Constable (Brass No. 759) was dismissed with effect from 31.08.2006 after a departmental enquiry into charges that, while on SOP training at TTS Jamshedpur, he evaded standby duty on Holi (26.03.2005), consumed alcohol, and attempted to rape and molest a village woman, leading to Golmuri P.S. Case 43 of 2005. The Jharkhand High Court held the enquiry gave him full opportunity of hearing, the findings rested on evidence including the Training School Principal's statement, and absence from duty coupled with molestation/attempted rape was serious misconduct.
