Complainant \[name withheld\] was picked up and held overnight in the Ezhukone police lock-up on 8-9 February 1996, where he was beaten and burnt on the tongue with a cigarette so that he could not complain to the Magistrate; the trial court and appellate court concurrently convicted the SI and three constables under Sections 323 and 324 read with Section 34 IPC. The Kerala High Court rejected the Section 197 CrPC sanction defence, holding custodial torture is not an act done in the discharge of official duty. The court dismissed both criminal revision petitions, confirming one year simple imprisonment with Rs 2,500 fine each under Section 324 and Rs 1,000 fine each under Section 323, with Rs 10,000 of the fine payable to the complainant as Section 357(1) CrPC compensation. Matters not addressed in the cited judgment text are not recorded here.

> In the light of the foregoing discussions, this Court has no hesitation to hold that the trial court and the appellate court are not in error and are perfectly justified in finding accused Nos.1 and 3 to 5 guilty for the offences under Sections 323 and 324 read with Section 34 IPC, convicting them and imposing punishments on them for those by the impugned judgment.
