The judgment of the Madras High Court records the following account. the survivor was admittedly taken from her Panruti home to Tindivanam Police Station on 26.01.2011 by mistaken identity, illegally detained over seven hours, beaten with a lathi and molested inside the station. Her SHRC complaint was dismissed for default and her writ petition dismissed on 08.11.2012 for not naming the policemen. On 23.11.2021 a Division Bench of the Madras High Court held both dismissals wrong, recorded prima facie satisfaction with the custodial-violence complaint, and invoked public-law compensation under D.K. Basu. The Court set aside both orders, directed Rs.3,00,000 interim compensation within four weeks, and remanded the matter to the SHRC to identify the officers and enquire afresh. Matters not addressed in the cited judgment text are not recorded here.

> For all the aforementioned reasons, having been prima facie satisfied with the complaint of custodial violence, for outraging the modesty of the appellant, being the mother of two female children, while setting aside the order passed in the writ petition as well as the order passed by the State Human Rights Commission, we remand the matter back to the file of the State Human Rights Commission to enquire into the complaint of the appellant afresh and find out who are the officers who have illegally detained the appellant and committed custodial violence on 26.1.2011, as per the procedure established by law, within a period of five months from the date of receipt of a copy of this order. Considering the facts and circumstances of the case, we also direct the respondent State to pay a sum of Rs.3,00,000/- (Rupees three lakhs only) as interim compensation to the appellant within a period of four weeks from the date of receipt of a copy of this order, leaving it open to the State Human Rights Commission to do the needful on merits and in accordance with law.
