The Bombay High Court (A.S. Chandurkar, J.; Rajesh S. Patil, J. concurring) held that Police Inspector (ex-SHO, President's Police Medal 2004) was arrested illegally on 13 March 2013 at 17:15 by Addl. SP Amol Tambe over alleged faulty investigation in Crime 19/2009 and kept about 20 hours till bail on 14 March 2013. No State consent under Section 45(2) CrPC was obtained though he was a police officer acting in official duty, arrest memo/grounds were not recorded, the station diary entry was made 6+ hours late, and arrest was for bailable offences (ss. 201/218/221 IPC) without recording reasons. Finding gross Article 21 violation, the Court awarded Rs. 2,00,000 compensation from the State within eight weeks (6% p.a. interest on default), with recovery from guilty officers permitted after due process. Matters not addressed in the cited judgment text are not recorded here.

> We find that the petitioner was arrested in an illegal manner and thereafter detained which was not in accordance with the provisions of Sections 45(2), 50 and 56 of the Code as well as the law laid down by Supreme Court of India.
