The judgment of the Punjab and Haryana High Court records the following account. \[name withheld\] and colleagues were implicated in FIR No. 62 dated 25 March 2001 and convicted on 26 October 2012 under Sections 323, 342, 167 and 34 IPC with three years rigorous imprisonment, being acquitted of the murder charge, and were dismissed on 16 November 2012. The High Court held that no punishment other than dismissal can be awarded where an enrolled police officer is sentenced to rigorous imprisonment exceeding one month under Rule 16.2(2) of the Punjab Police Rules. The court rejected the plea for conversion of dismissal into compulsory retirement on parity with a co-accused and dismissed the writ, so the dismissal stands while the criminal appeals remain pending.
