The High Court held that there are no prospects of a free and fair investigation of the assault case by the Investigating Agency of UT, Chandigarh. The Court found that the Chandigarh Police SIT was proceeding in a tainted manner to give benefit to the accused serving police officials and was trying to create loopholes in the investigation. The Court noted that the SIT called the accused untraceable though all were serving police officials and had already made up its mind to delete the attempt-to-murder charge. The Court withdrew the investigation from UT, Chandigarh with immediate effect and handed it to the Central Bureau of Investigation. The Supreme Court later dismissed the accused officers' petition challenging the transfer, leaving the High Court's order intact.
