The Division Bench held that law student and Bhilai hotel operator \[name withheld\] was subjected to an illegal hotel raid at Kohka on 8 September 2025, arrest without FIR on mere suspicion, and mechanical remand, establishing illegal arrest, unlawful detention and unwarranted incarceration in breach of Article 21. The court awarded Rs 1 lakh compensation as public-law remedy within four weeks (9% interest on default), recoverable from the erring Smriti Nagar officials after due inquiry. It quashed the preventive order dated 8 September 2025, the istagasha and criminal case No. 1379/2025, lamenting that illegal arrest and custodial violence erode public trust.
