The judgment of the Madhya Pradesh High Court records the following account. Petitioner a Kailaras man, a serving police constable, was arrested by the Station House Officer of Kailaras Police Station, Morena, in connection with a bailable offence under Sections 308(7) and 3(5) of the Bharatiya Nyaya Sanhita. Despite the petitioner being entitled to bail and willing to furnish sureties, the police failed to inform him of his statutory rights under Section 47(2) BNSS and kept him detained in the police lock-up for over 24 hours until his production before a Magistrate. The Madhya Pradesh High Court (Gwalior Bench) declared the arrest and detention unlawful and violative of Article 21 of the Constitution, awarding Rs. 5,00,000 as public law compensation to be paid by the State with liberty to recover the sum from the delinquent officer. Matters not addressed in the cited judgment text are not recorded here.

> In the present case, this Court finds that respondent No.4 failed to adhere to the mandatory statutory procedure governing arrest in a bailable offence. The petitioner was illegally deprived of his liberty without authority of law. Such action constitutes a clear infringement of Article 21 of the Constitution of India.
